1. General

These Terms & Conditions ("Terms") govern your use of the HI AI Works website (hiaiworks.com), operated by HI AI Design under the HI AI Works brand, and all associated products and services, including Jobfair AI and AI Brewery ("the Services").

By accessing our website or purchasing our products, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

2. Definitions

• "System Prompt Kit": A Markdown file (.md) containing engineered system instructions designed to configure an AI model for a specific professional role.
• "Artificial Employee": The resulting AI agent created by applying a System Prompt Kit to a compatible AI platform.
• "The Brewery" / "AI Brewery": Our e-commerce platform for purchasing System Prompt Kits.
• "Jobfair AI": Our CV analysis and fair hiring platform.
• "User" / "Customer": Any individual or entity using our website or purchasing our products.

3. Products & Licensing

3.1 System Prompt Kits (AI Brewery)

Upon purchase, you receive a perpetual, non-exclusive, non-transferable licence to use the System Prompt Kit for your own personal or internal business purposes.

• You may: use, modify, and customise the .md file for your own use; deploy the prompt across any supported AI platform; create derivative works for internal use.
• You may not: resell, redistribute, sublicence, or publicly share the original or modified System Prompt Kit; claim authorship of the original work; use the Kit to build a competing product or service.

3.2 Jobfair AI

Access to Jobfair AI is subject to separate terms governing fair hiring practices, data processing of candidate information, and compliance with employment discrimination laws. A dedicated Jobfair AI Terms of Service will be published upon product launch.

4. Pricing & Payment

• All prices are listed in Euros (€) and include applicable VAT where required.
• Payment is a one-time purchase. There are no recurring subscriptions.
• Prices may be updated at any time. Existing purchases are not affected by price changes.

5. Delivery

System Prompt Kits are digital products delivered electronically as downloadable Markdown (.md) files. Delivery is immediate upon successful payment. No physical goods are shipped.

6. Right of Withdrawal (EU Consumers)

Under EU consumer protection law, you have a 14-day right of withdrawal for online purchases. However, for digital content supplied immediately upon purchase:

7. Intellectual Property

• All content on this website, including text, design, graphics, logos, and code, is the intellectual property of HI AI Design unless otherwise stated.
• The System Prompt Kits are original works authored by HI AI Design. Copyright remains with HI AI Design; the licence granted is for use only.
• "HI AI Works", "AI Brewery", "Jobfair AI", and associated branding are brands of HI AI Design.

8. Disclaimers & Limitations

• System Prompt Kits are instructions for AI models. The output quality depends on the underlying AI platform, model version, and how the kit is deployed. We do not guarantee specific outcomes.
• AI-generated outputs should be reviewed by qualified humans before use in legal, financial, medical, or critical contexts.
• Our liability is limited to the purchase price of the product. We are not liable for indirect, consequential, or incidental damages arising from the use of our products.
• Jobfair AI provides decision-support tools, not automated decisions. Final hiring decisions must always involve human judgement.

9. User Responsibilities

You agree to:

• Use our products lawfully and ethically
• Not use System Prompt Kits to generate harmful, illegal, discriminatory, or deceptive content
• Comply with the terms of service of whichever AI platform you deploy on
• Take responsibility for outputs generated by your configured AI agents

10. Bespoke Commissions

Custom ("Bespoke") System Prompt Kits are subject to additional terms agreed upon before work begins, including:

• A written brief and scope of work
• Agreed timeline and number of revision rounds
• Payment terms (deposit + final payment)
• The same licensing terms as standard kits apply unless otherwise agreed in writing

11. Governing Law & Jurisdiction

These Terms are governed by the laws of France. Any disputes shall be submitted to the competent courts of Paris, France.

12. Modifications

We reserve the right to update these Terms at any time. Material changes will be communicated via the website. Continued use of the Services after changes constitutes acceptance.
